The documentary Last Will and Embezzlement will fire you up with righteous indignation, as it should. As estate planning attorneys, we know all too well about the horrible betrayal of trust and shocking manipulation that goes on in the lives of many elders. We have seen and heard firsthand what can happen when someone decides to fleece their aging parents or even a complete stranger. That is why we do what we do ? protect senior?s assets from predators. We have all heard about Mickey Rooney?s son financially abusing him, and this is just the tip of the iceberg.

Elder exploitation is the easiest thing in the world for criminals to achieve. It is illegal, but usually safe to pull off and highly profitable. How easy is it to just walk into a nursing home where residents struggle with cognitive difficulties, hand them a document that signs away access to their finances, and walk out holding the keys to the bank? It?s easier than you might think.

This unconscionable theft and manipulation is typically carried out by someone whom the senior knows and trusts. The perpetrator just creeps into the elder?s life and becomes a part of it, building trust, sharing stories, gaining the confidence of their victim ? and then ? they strike. It may start out as requests for small amounts of money to tide them over.

Over time, the checks get larger and more frequent. One day, there is no more money, and no more happy-go-lucky-relative. The person whom the victim thought was taking care of them is gone with the money. There is no horror greater than someone abusing a senior and leaving them destitute, preying on their vulnerabilities, but it?s on the rise. Why?

Seniors are becoming the prey du jour for a number of reasons. The two major reasons are that the senior population is increasing, as the baby boomer generation ages, and that the family trying to care for them are between a rock and a hard place financially, trying to care for them. The result is often financial elder abuse.

As estate planning attorneys, we are well-positioned to help many individuals avoid abusive situations. It is incumbent upon us to take up that torch and protect seniors, who paved the way for us today.

Burton Snowboards Restructure: Analog Back to Vermont, Gravis to Japan

Burlington, Vt.-based snowboarding company Burton Snowboards has announced a restructuring plan that will see the closure of the Costa Mesa headquarters for two of its brands.

The changes are intended to bring Burton back to a focus on its core snowboarding gear and related products, according to the company.

?Burton has experienced several years of income growth since the recession and paid out bonuses to employees over the last two years,? Burton Chief Executive Jake Burton said in a statement. ?That said, the economy has a voice of its own that we all have to listen to, and the message is clear: do what you do best and focus purely on it. In our case, that means to narrow our focus to the sport and lifestyle that got us here?snowboarding.?

Burton?s Costa Mesa office is home to its Analog Clothing skateboarding-, snowboarding- and surfboarding-inspired brand along with shoemaker Gravis Footwear.

Burton told trade publication Transworld Business that the move out of Costa Mesa is expected to be done over the next six months.

Analog is expected to return to Burton?s Vermont headquarters and will become a snowboarding-only brand, ending its ties with the surf and skate world by next fall. The Analog brand will sell outerwear and technical clothing only during the winter.

Gravis, which mainly sells footwear, will move to Tokyo and will only be available in Asian markets, where the brand is most popular. The change for Gravis will be effective fall 2013.

Burton moved its Analog division from Vermont to Irvine in 2004. The company moved to Costa Mesa earlier this year.

The restructuring also impacts other Burton brands, including its RED helmet and protective wear brand and eyewear brand Anon among others.

Massive day for San Jose soccer

What a day for the San Jose Earthquakes, who poured a lot of history into one afternoon.

It did not end perfectly as the club could manage only a 2-2 draw with the Galaxy. But in the big picture that singular result in one little ol? soccer game doesn?t mean a thing.

The Earthquakes had officially captured the Supporters Shield a night before, when Sporting Kansas City failed to grab all the points in a draw at New York. Long, slow applause for that one.

With a brave header in the second half of Sunday?s contest, Chris Wondolowski moved a step closer to historic heights. So many will be pulling for him in this week?s season finale, as he attempts to match Roy Lassiter?s 17-year-old record for most goals over a single MLS season.

But again, the match and the individual heroics are radar blips in the big, big picture for owner Lew Wolf (pictured, along with ? uh ? well, he?s pictured) and his club. ?San Jose?s well-attended ground-breaking on a new 18,000-seat facility (set to open in 2014) is what really matters.

The organization even broke a Guinness world record (quaint as Guinness world records seem these days) for the largest groundbreaking. Some 6,256 fans had small shovels and dug for two minutes in the ceremonial construction start.

We keep saying it ? but it continues to be true. Nothing matters more in Major League Soccer?s ongoing development than getting clubs into their own, dedicated facilities. TV contracts are important, too ? but these new arenas were always the first building blocks in that initiative, too.

As successful as San Jose has been on the field and at the gate in 2012, existence as a renter, stripped of opportunities to control all those important revenue streams, is not sustainable for any franchise.

Further, nothing establishes a sense of permanence and staying-power like a physical building. It helps to establish ?place? in the community and it tells fans, media and potential sponsors ?we aren?t going anywhere.?

San Jose?s facility will be the 15th to constructed or rebuilt specifically for an MLS club.

? Top-seeded Juan Martin del Potro won his 12th career title Sunday, beating qualifier Grega Zemlja of Slovenia 7-5, 6-3 at the Erste Bank Open.

It's only the second indoor title for the Argentine, who was playing his first event since returning from a right wrist injury that sidelined him for more than a month.

"It's been a fantastic week," the eighth-ranked Del Potro said. "Coming back to the tour and being seeded No. 1 put me under pressure. I am so happy now. Winning a tournament means a lot. It's important to have a good end to the year."

Del Potro improved to 12-5 in finals and is a strong favorite to pick up one of the remaining berths at the season-ending ATP World Tour Finals.

"That was on my mind coming here," he said. "I am looking even better now ... but I still have two big tournaments and must do well in Basel and Paris."

A losing finalist last year, Del Potro survived a shaky start against the 70th-ranked Zemlja, who was the first player from Slovenia to reach a final after upsetting Janko Tipsarevic in the semifinals.

At 2-2 in the opening set, Del Potro lost serve for the first time in the tournament. But from 2-4 down, he won 11 of the next 15 games to close out the victory.

"It wasn't a good start, I was nervous because it was a final," Del Potro said. "In the second set, I broke him early and that gave me confidence to play the final like everyone expected me to do."

Zemlja's defeat left Finland's Jarkko Nieminen as the only qualifier to win an ATP tour event this season, after winning in Sydney.

"I am satisfied," Zemlja said. "My first semifinal, my first final, is was a great week. I am happy with my tennis, I know now that I can beat everybody."

Zemlja started well in the final but only converted one of his five break points to let Del Petro escape. He missed three chances with the Argentine serving at 4-4.

"In the first seven games, I was aggressive," Zemlja said. "I thought I was ahead of him regarding my game plan. It didn't work out in the closing stages of the first set and from then on he was the better player. Del Potro raised his level and his forehand is the best in the world."

Family escapes house fire unharmed - wave3.com-Louisville News ...

LOUISVILLE, KY (WAVE) ? A fire destroyed a family's home in east Louisville.

Investigators are trying to figure out what caused the fire on Meadow Field Drive around 1:40 Saturday morning.

Neighbors said the fire started in the back of the home and residents were home, but were able to get out.

According to neighbors, a fund has been set up at Fifth Third Bank in the name of Dan and Alicia Hayes.

Also, I do agree that a character sheet would be nice and if it is anime or not. I don't really like anime, personally but I will do it if needed :)

I'm not mad, my reality is just different than yours.

Many long for immortality but haven't a clue what to do on a rainy Sunday afternoon.

Need (more) Advice... - Adoption.com Forums

First of all...he has never had a daddy before, right? And, you being mommy...it may be confusing. But, my kiddos(whom we have had each from birth) absolutely flip when Daddy gets home(he is often gone all week for work, too)...they cry and carry on as soon as he gets home...if he gets home right before bedtime it is a *nightmare*...at first, I was kind of put off by it...but, the pp is right, it is the novelty and the fact that he is the one who is NOT there...because when I went to Hawaii for 8 days with my mom and sisters, the kids did the same thing with me when I got home...and my dh said they did all of the usual behavioral stuff in response to my being gone...in fact (probably for my ego!LOL!) he swears it was worse...that they were pretty sober and sad the whole time...my son attests to that...probably just smart guys! They know when to schmooze the mama!LOL! BUT, they did react the same when I got home...

Also, have you considered that you are the one bringing him to the visit that freaks him out...so, naturally he asks for Daddy...because in his little mind, Daddy did NOT bring him here...and he does NOT want to go in there and for whatever reason, he knows you can't save him from it. Poor little man...hang in there mom. It is not uncommon at all!!

I will say it is nice to know I am not the only one who ever felt this way, though...it is easy to tell someone else, but I have felt it and it's not cool...just like you said, logistically...I am the bomb...but, he is so patient and playful...makes me feel like the workhorse!LOL!

'Broken heart' and other fake sick day excuses

It's no surprise that not everyone who calls in sick isn't doesn't really have the sniffles.?Thirty percent of workers admitted to calling in sick when they weren't actually under the weather, a new Careerbuilder survey reports.

What might be surprising are some of the more creative excuses they've tried to use to get out of work, and just how many employers are out to catch them.

The online poll conducted by Harris Interactive surveyed 3,976 workers and 2,494 U.S. hiring managers and human resource workers. In addition to raw numbers, Careerbuilder also collected the memorable excuses bosses had heard.

How about the employee who called in sick because they were "upset after watching 'The Hunger Games'"? Or the guy who said he "forgot he was hired for the job?" Or the person who couldn't come in to work because they were "sick from reading too much"?

Other eyebrow-raising reasons included "toe stuck in faucet," "dead grandmother being exhumed for police investigation," "bird bite," "broken heart," and "sobriety tool wouldn't allow car to start."

What motivates the strategies behind these excuses??"Some subscribe to a 'less is more' mentality while others may feel the more detail they provide, the more believable the excuse will be," said Rosemary Haefner, CareerBuilder?vice president of human resources.

Bosses are on the watch for flimsy excuses and will take steps to sniff out a faker. A surprising 29 percent of employers said they checked out an employee's story, most commonly by asking for a doctor's note or calling the worker later in the day.

Fourteen percent said they even drove by an employee's house, which just sounds creepy and not useful. What are you going to do, peer through their blinds and see if they're doing Zumba when they should be under the covers?

And here's one to stoke your paranoia. Bosses may even recruit your co-workers to ferret out the truth -- 18 percent of employers said they tried this ruse.

Employees fraudulently cash in sick days for a variety of reasons, but basically it's to carve off extra time for themselves. If they weren't actually sick, 34 percent said they called in sick because they didn't feel like going to work, 29 percent said they "needed to relax," 22 percent needed to make a doctor's appointment, 16 percent were catching up on sleep, and 15 percent wanted to run errands.

Those who call in fake sick days "may be repeat offenders for truancy or may be concerned about how their boss may perceive them," said Haefner. "However, if you?re caught lying, that can have more serious consequences and bring your professionalism and reliability into question. It?s better to be honest."

Should an employer catch you in your lie, it could lead to them becoming a former employer. Seventeen percent of bosses said they fired an employee for giving a a fake excuse. Then you'll have all the sick days you need.

The appointee will have access to wide-ranging infrastructure resources and many collaborative opportunities within the department and college, and with colleagues in campus units such as the School of Medicine, School of Nursing, School of Veterinary Medicine, California National Primate Research Center and College of Biological Sciences.

Responsibilities: The Department of Nutrition is seeking applicants who focus on integrative approaches to understanding the role of nutrition in health, development and chronic disease. Candidates should be able to work in multidisciplinary teams utilizing basic science tools in research involving human nutrition trials to study health at the individual and population level. This position will build upon the signature strengths of the department including international and community nutrition interventions, micronutrient and bioactive food component metabolism, and maternal/child nutrition. The appointee will be expected to pursue understanding of metabolic phenotypes and underlying biologic mechanisms in order to optimize translation of nutrition recommendations for individuals and public policy.

The appointee will be responsible for teaching an undergraduate course in the core curriculum for the two majors offered by the Department (Nutrition Science and Clinical Nutrition), as well as other courses assigned by the department chair to meet the teaching needs of the departmental curricula. Mentoring of graduate students, undergraduate student advising, curricular development, participation in and development of outreach programs, and performance of departmental and university service is expected. The appointee is expected to conduct fundamental research, train students, and provide outreach that will further the mission of the department and the University of California. Qualifications: Ph.D. or equivalent degree in Nutrition, Biology, Medicine, Public Health or related fields; post-doctoral experience preferred. Evidence of research excellence is expected. Research interests and strong skills in application of cutting edge nutrition research techniques and relevant experience in human intervention research preferred. The candidate should have the ability to work in and lead interdisciplinary collaborative teams utilizing mechanistic and translational approaches to understand issues of individual and global importance, including prevention and consequences of both under and over nutrition. Women respond better to the treatment of lymph gland cancer with ...

(Medical Xpress)?Women respond much better than men to the treatment of chronic follicular lymphoma with a monoclonal antibody that targets CD20 (rituximab). These are the findings of a multi-centre, Austria-wide study by the Arbeitsgemeinschaft medikament?se Tumortherapie (AGMT) carried out under the supervision of the University Department of Internal Medicine I and study leader Ulrich J?ger, which has now been published in the journal Haematologica. It was also discovered that the volume of lymphoma cells has an important role to play.

Says J?ger: "This means that men with a large tumour or bone marrow infiltration respond poorest to antibody therapy, while women without bone marrow involvement and a small tumour respond best."

Follicular lymphoma is a chronic cancer of the lymphatic glands which frequently recurs after a temporary remission, i.e. a reduction in lymph node swelling and symptoms of illness. Around 40-50 new patients a year are treated for the condition at the University Department of Internal Medicine I. Follicular lymphoma primarily occurs in the lymph nodes or in the bone marrow.

Until now, it was only known that women with this condition generally have a better prognosis. "They have also fared particularly better, however, since the antibody Rituximab has been used as treatment," says the haematologist who is (currently) also the President of the European Hematology Association (EHA).

The study has shown that blood concentrations (serum concentrations) in women are around 20 per cent higher than in men over the period of treatment with Rituximab. Women achieve saturation of the blood concentration with the antibody during the fourth cycle of therapy, significantly earlier than male patients.?

"The next step must therefore be to carry out studies in which we give men this antibody more often or at a higher dose at the very start of treatment, in order to determine whether this improves the prognosis of male lymphoma patients," says J?ger. "We also need to look at other conditions in which antibodies are used in order to determine whether there is a similar gender-specific effect taking place." These studies are being planned.

LEXINGTON, Ky. - Just a heartbeat away from the presidency.

Vice President Joe Biden and Wisconsin Rep. Paul Ryan will face off in their only head-to-head meeting of the presidential race tonight as the Democrats look for a boost after President Obama's lackluster effort in Denver last week and Republicans seek to maintain some momentum after Mitt Romney's command performance.

Apart from what happens on stage this evening, ABC News Political Director Amy Walter points out that tonight's event comes on the heels of a round of new polls showing last week's debate did not completely transform the race, but it did provide Romney the opportunity to improve his battered image.

In every state poll released today, Romney saw his favorables tick up - not a lot - but some. This means voters are now more receptive to what Romney has to say at the next debate.

Meanwhile, Ryan is still something of a mystery to swing state voters.

A whopping 27 percent of Colorado voters and 28 percent of Virginia voters in today's New York Times-CBS News-Quinnipiac University poll said they don't know enough about him to offer an opinion.

Biden doesn't fare much better. In most of these states his favorable ratings are lower than the president's. And, even after four years in office, plenty of voters still don't know enough about him to have any opinion of him at all.

That puts lots of pressure on both men to not only define and defend their running mate, but to make a solid first impression of themselves as well.

I don't want to say anything in the debate that's not completely accurate," Biden said on Oct. 4 in Council Bluffs, Iowa.

RYAN VS. PALIN: WHAT'S DIFFERENT THIS TIME? While a campaign official told ABC News Biden's team is "not re-inventing the preparation wheel," the approach Biden takes at Thursday night's debate may differ from the way he handled his debate against Palin. In the 2008 vice presidential debate, Biden focused most of his attention on attacking Republican presidential nominee Sen. John McCain, with only making passing references to Palin. But in this year's debate, Biden will likely target Ryan, who he says has given more definition to Romney's campaign, and his programs head on. "Like President Obama, Vice President Biden will use the upcoming debate as an opportunity to speak directly to the American people about what's at stake for the middle class in this election," a campaign official said. "He will continue to drive home the specific plans he and the president have to keep strengthening our economy and the middle class."

MEMORABLE DEBATE MOMENTS. Aug 23, 1987 - In his closing speech at a debate at the Iowa State Fair, Biden used the same speech delivered by Neil Kinnock, a leader of the Labor Party in Britain, without crediting Kinnock. Biden had incorporated phrases of Kinnock's speech at various campaign appearances before the debate, but he always credited the Briton for his remarks. The incident, coupled with news of Biden's plagiarism while in law school, eventually drove the Delaware senator to drop out of the presidential race.

April 26, 2007 - After moderator Brian Williams noted Biden's gaffe prone narrative, he asked Biden if he could "reassure voters in this country that you would have the discipline you would need on the world stage," to which Biden simply responded "Yes," setting off rounds of laughter from the audience.

Oct 2, 2008 - Biden choked up when talking about raising his two sons alone after a car accident killed his wife and young daughter. "The notion that somehow because I'm a man I don't' know what it's like to raise two kids alone. I don't know what it's like to have a child you're not sure is going to make it. I understand, I understand, as well as with all due respect the governor or anybody else what it's like for those people sitting round that kitchen table. And guess what? They're looking for help. They're looking for help. They're not looking for more of the same."

CONGRESSMAN PAUL RYAN: With eight debates under his belt, but none on the national stage, the kid is hungry. Mitt Romney looked poised during last week's debate against President Obama, and Paul Ryan enters Round 2 tonight after intense preparations: For over a month, Ryan has studied, practiced, and game-planned with staff during sessions at his home in Janesville and at a multi-day debate "camp" in Virginia, ABC's Shushannah Walshe reports. Debate prep seems to be a strategic priority for the Romney campaign, but tonight Ryan will face a far more experienced (if mistake-prone) opponent. HOW RYAN PREPARED. Ryan began at home in Janesville Sept. 2, watching Biden and Sarah Palin, according to an aide. He ramped up his preparation on Sept. 9, working with aides all day, except for a small break to watch the Green Bay Packers' game. His efforts continued in Janesville and in Washington, D.C. in September before he underwent four days of intense prep at his "debate camp" in Wintergreen, Va. Oct. 3-6. His only break was a rally with Mitt Romney in Fisherville, Va., last Thursday, and Ryan conducted two full-length mock debates with former solicitor general Ted Olson standing in as Vice President Joe Biden. He finished up on Wednesday, with another full-length run-though planned at The Vinoy hotel in St. Petersburg, Fla.

WHO ATTENDED RYAN'S DEBATE PREP? A slew of top aides were on hand for Ryan's prep work in Virginia and Florida. While Ted Olson stood in for Biden, Mitt Romney's advisor and former lieutenant governor, Kerry Healey, played ABC's Martha Raddatz. Aides in attendance included Romney foreign-policy advisor Dan Senor, Ryan Chief of Staff Andy Speth, Ryan House Communications Director Conor Sweeney, traveling campaign press secretary Michael Steel, Romney Communications Director Gail Gitcho, and Romney Senior Advisors Russ Schriefer and Ed Gillespie.

HITTING THE BOOKS. Before Ryan was even selected as Romney's running mate, staffers began assembling briefing books on different policy issues in large white binders. At the very beginning of debate prep that's where Ryan started, according to an aide at the time: "A lot of what he has done thus far has consisted of reading briefing books and editing briefing books to make sure that those binders reflect not just the policies of the Romney-Ryan campaign but also sound like him, things that he is comfortable with ? reading information, absorbing it, putting in his own words and getting really comfortable with it," the aide said.

TED OLSON: RYAN'S SPARRING PARTNER. Who is Ted Olson? The Republican attorney famously argued in federal court for same sex marriage and against Proposition 8. Paul Ryan is against same sex marriage. At a LGBT dinner in Washington D.C. in March, the renowned attorney called the battle against Proposition 8 "the highlight of my life" and "this is the most important thing we've done in our lives," according to the Washington Post. Olson also served as Solicitor General in the George W. Bush administration, and as Assistant Attorney General for the Office of Legal Counsel in the Administration of Ronald Reagan. He also served as private counsel to both Bush and Reagan. He helped to cement Bush's victory in the 2000 presidential election during the recount.

ON THE WAY TO DANVILLE, RYAN LOWERS EXPECTATIONS. Most recently at an ice cream stop in St. Petersburg on his way to Danville, Kentucky for the debate he acknowledged that it's a "nervous situation" and tried to tamp down expectations for himself. "Joe Biden has been on this stage many times before," Ryan said while ordered two scoops of Moose Tracks ice cream. "This is my first time so sure it's a nervous situation because Joe Biden is one of the most experienced debaters we have in modern politics, but the Achilles Heel he has is President Obama's record and I'm really looking forward to giving the American people a very clear choice." He denied being more concerned about one issue over another and said his final debate prep at the beautiful Vinoy Hotel here "went well."

RYAN'S DEBATE HISTORY. Despite what Mitt Romney said Tuesday, Ryan has participated in at least eight debates over his fourteen years in Congress, according to available news articles and information provided by the Ryan campaign. An examination of them shows topics that have been raised during this campaign, from his vote for TARP to Medicare.

1998 - Ryan, 27, debates Democratic opponent Lydia Spottswood, 47, who notes that she is old enough to be Ryan's mother.

2000 - Ryan debated Democratic challenger and Janesville surgeon Jeffrey Thomas, and even then the debate focused on Social Security and Medicare, according to the Journal Times of Racine, Wisc. "In 1965 they didn't have the prescriptions we do today," Ryan said to Thomas."I believe we need to modernize Medicare."

2010 - When opponent John Heckenlively brought up partisan gridlock, Ryan complained that Democrats never allowed debate on GOP bills. "Switch control of Congress and then we'll have to work together," Ryan said.

BATTLE OVER BENGHAZI: SECURITY OFFICIALS TESTIFY. Security and State Department officials testified Wednesday before the House Oversight and Government Reform Committee, and ABC's Jake Tapper reports for "World News": That horrifying night in Benghazi had former security officials in Libya today condemning their superiors for denying their requests for more security agents. Eric Nordstrom, the former security officer at the U.S. embassy in Libya today recalled his biggest frustration as being the State Department. Nordstrom suspected the denials for more security were rooted in a fear of making Libya seem more unstable, but a State department official today denied any politics were at play. OBAMA ON THE BENGHAZI EXPLANATION. ABC's Diane Sawyer asked President Obama about U.S. intelligence on the attack and the administration's initial suggestions that it began with a protest sparked by the now-infamous anti-Muslim video filmed in the U.S. Obama told ABC: "As information came in, information was put out. ABC's Jake Tapper reports: In a heated and dramatic congressional hearing today, witnesses who served with the U.S. diplomatic corps in Libya and pushed for a stronger security presence repeatedly faulted the State Department for standing in their way - one even referring to the State Department officials he described as obstructionist as if they were Taliban terrorists. The former regional security officer in Libya, Eric Nordstrom, recalled talking to a regional director and asking for twelve security agents. "His response to that was, 'You are asking for the sun, moon and the stars.' And my response to him - his name was Jim - 'Jim, you know what makes most frustrating about this assignment? It is not the hardships, it is not the gunfire, it is not the threats. It is dealing and fighting against the people, programs and personnel who are supposed to be supporting me. THE GRIEVING WIDOW BEHIND ROMNEY'S STUMP SPEECH. ABC's Emily Friedman profiles Jane Horton, whose husband is featured in Mitt Romney's stump speech: Jane Horton began crying on the other end of the phone when she learned that Mitt Romney had been using the story of her husband, Chris Horton, who was killed in Afghanistan, as a part of his stump speech. "Wow," the 26-year-old said. "I had no idea. "To be honest, I've been through a lot and I'm not a super emotional person but it brings me to tears," Horton said in an interview with ABC News, after being informed of her husband's newfound spot on the national stage. "Not that he's telling my story, but that he's telling my husband's story, it means the world to me. "One of the last things my husband said to me before he was killed, when I would ask him, 'Chris, what do you need over there? ROMNEY CLARIFIES ABORTION STANCE. ABC's Emily Friedman reports from Delaware, Ohio: A little more than 24 hours after he told an Iowa newspaper that abortion legislation would not be part of his agenda if elected, Mitt Romney told reporters today that he would "immediately" move to defund Planned Parenthood. "I've said time and time again, I'm a pro-life candidate," Romney told reporters during a stop at a restaurant in Ohio today. "I'll be a pro-life president. The actions I'll take immediately are to remove funding for Planned Parenthood. It will not be part of my budget. PAUL RYAN'S HOUSE OPPONENT WANTS A DEBATE, FOLLOWS HIM TO DANVILLE. Paul Ryan's House challenger will be in Danville, Ky., site of the vice presidential debate on Thursday, asking for a debate of his own. Rob Zerban, the Democrat challenging Rep. Ryan, R-Wis., will be doing national interviews in Kentucky, telling reporters that Ryan has neglected his home-district House campaign. Ryan, who presumably has his hands full running for vice president and debating Joe Biden, has refused to debate Zerban, so far. Zerban has circulated a petition among his supporters demanding a debate. AFFIRMATIVE ACTION AT SCOTUS: JUSTICES SKEPTICAL OF TEXAS PLAN. ABC's Ariane de Vogue reports: At the Supreme Court today, the conservative justices had skeptical questions for a lawyer defending the University of Texas' plan that takes race into consideration in the admissions process. One of their main concerns goes to the heart of the case: at what point does the court stop deferring to a university's judgment that the consideration of race is still necessary? "I understand my job under our precedents is to determine if your use of race is narrowly tailored to a compelling interest, "Chief Justice John Roberts said to Gregory Garre, a lawyer representing the University of Texas. COURT BLOCKS S.C. VOTER ID LAW-FOR 2012. ABC's Ariane de Vogue reports: A federal court in Washington today blocked South Carolina's Voter ID law from going into effect for the 2012 elections, but said it could go into effect for future elections. Under Section 5 of the Voting Rights Act, South Carolina-because it has a history of discrimination-had to get approval for the law from federal officials in Washington DC. "He shouldn't make my son's death part of his political agenda.
