Ben Affleck and Jennifer Garner have already proven that they don't mind straying a bit from the classics for their child-naming proclivities, but did they switch up their technique for their new baby boy?

You may be surprised. The couple Wednesday shared the moniker they chose for their now 2-day-old son -- and it truly seems to be a mutual collaboration. So what is it?

The first of the brood to have scored mama's maiden name as his middle moniker, there was no further comment or explanation of the strong, classic, and dare we say New England-appropriate moniker (Sam Adams. Sam Malone. Sam Affleck.) Hey, you can take the man out of Boston, but you can't take the Boston out of the man. Or baby boy, it would seem.

Little Sammy joins big sisters Violet, 6, and Seraphina, 3, in the Bennifer brood. Congrats to the happy family!

(AP) ? Lumber, boats and other debris ripped from Japanese coastal towns by tsunamis last year have spread across some 3,000 miles (4,828 kilometers) of the northern Pacific, where they could wash ashore on the U.S. west coast as early as a year from now.

The National Oceanic and Atmospheric Administration estimated the first bits of tsunami debris will make landfall soon on small atolls northwest of the main Hawaiian Islands. Other pieces were expected to reach the coasts of Oregon, Washington state, Alaska and Canada between March 2013 and March 2014.

NOAA's tsunami marine debris coordinator, Ruth Yender, told an online news conference Tuesday that agency workers were boarding Coast Guard flights that patrol the Hawaiian archipelago. NOAA also asked scientists stationed at Midway and other atolls to look for the debris.

Debris initially collected in a thick mass in the ocean after tsunamis dragged homes, boats, cars and other parts of daily life from coastal towns out to sea. Most likely sank not far from Japan's eastern coast.

In September, a Russian training ship spotted a refrigerator, a television set and other appliances west of Hawaii. By now, the debris has likely drifted so far apart that only one object can be seen at a time, said Nikolai Maximenko, a University of Hawaii researcher and ocean currents expert.

One to 2 million tons of debris remain in the ocean, but only 1 to 5 percent of that could reach Hawaii, Alaska, Oregon, Washington state and Canada's British Columbia, Maximenko said. The tsunamis generated a total of 20 million to 25 million tons of debris, including what was left on land.

Yender said that so far, no debris confirmed to be from the tsunamis has landed on U.S, shores, including large buoys suspected to be from Japanese oyster farms found in Alaska last year. The buoys would have had to travel faster than currents to get to Alaska at that time if they were set loose by the March 11 tsunamis.

Yender said there is little chance of any debris being contaminated by radiation. The debris came from a large swath of Japan's northeastern coast, not only near the tsunami-damaged nuclear power plant in Fukushima. Further, it was dragged out to sea with the tsunamis, not while the Fukushima plant experienced multiple meltdowns.

Nicholas Mallos, a conservation biologist and marine debris specialist for the Ocean Conservancy, said many of the objects in the debris were expected to be from Japan's fishing industry. That could pose a risk for wildlife, such as endangered Hawaiian monk seals, if fishing gear washes up on coral reefs or beaches.

"The major question is how much of that material has sank since last year, and how much of that remains afloat or still in the water column," Mallos said.

Maximenko said the dispersion of the debris makes it more difficult to track but no less hazardous.

"In many cases it's not density that matters, it's total amount," he said. "For example, if there's a current flowing around Midway island, that island would collect debris like a trawl moving across the ocean. It will collect all the debris on its way."

Ultimately, Maximenko said, tsunami debris will join garbage floating in a gyre between Hawaii and California produced by swirling Pacific currents. Much of that trash in a wide area known as the Great Pacific Garbage Patch is bits of plastic, which slowly breaks down into smaller pieces but doesn't completely disappear.

Reader Question: Should I Lease Or Purchase Catering Equipment ...

If you are planning on entertaining guests for a big event, party or gathering, you might want to consider hiring a caterer or catering equipment, to help you take care of all the food and beverage needs for your guests. However, if you are operating on a tight budget, the food and beverage service can be taken care of by you or a group of your friends and/or family members. This is often the most affordable way to ensure everyone has a great time, plenty to eat and most importantly keep the costs within your budget.

One of the disadvantages many people worry about when trying to do all the food & drink preparation themselves is that they will most likely not own the necessary kitchen equipment to cater for a large crowd. For example, if you only have the basics e.g. dishes, cups or drinking glasses to serve eight to twelve people, it can be hard to imagine how you will accommodate a large gathering of 100 guests or more.

Fortunately, there are places where you can lease catering equipment for the day, weekend or however long you will need it. This is by far the easiest and affordable way to get your hands on the necessary equipment and supplies you need without having to go out and spend money for a bunch of stuff you may never use again.

If you would rather go out and buy your own catering equipment, it is highly likely that you'll find the expenses far greater than you had initially anticipated. You may be looking at serving utensils, tables, linens, dishes and other supplies and all these items can all add up to a significant expense. However, if you entertain guests on regular occasion and these are items you will certainly use over and over again for future events, the cost may be well worth the investment. After all when you purchase your own catering equipment, you will never have to stress about leasing or borrowing these items again and they will always be available to you when you need them.

However, if you do not think that you will use the catering equipment enough to justify the expense, leasing is an affordable option that can make a great deal of sense. The one great advantage when choosing to lease or purchase commercial catering equipment is that you know you'll be working with quality products.

Online banking? Don't be afraid.

Online banking is commonplace these days, but many customers are hesitant to use it for fear of online scams, lack of computer skills, or difficulty finding convenient Internet access. Here's how to make online banking work for you.

When I wrote 365 Ways to Live Cheap in 2007, online banking was a feature that was far from standard, yet well on its way to becoming a standard. I often recommended to people that they seek out banks with online banking because it was a useful and valuable feature to have.

As I write this in 2012, if your bank doesn?t have at least some level of online banking, it?s definitely an outcast.

Still, I have many readers who do not use online banking as part of their normal money management routine.

The biggest hurdle for many is technophobia. They hear of internet scams and it convinces them not to use the service. Others simply aren?t all that adept at computers for various reasons.

Another hurdle is lack of convenient internet access. They don?t have internet access at home, so they don?t use many of the incredibly valuable online tools that can really save them money.

Falling into either group, unfortunately, means that you?re simply leaving money on the table. Online banking is an incredibly valuable resource.

For starters, it makes balancing your checkbook and checking your balance incredibly easy. This simple step alone can prevent many overdrafts. Many of the overdraft stories told to me by readers result from a misplaced digit in their checkbook ledger. Online banking largely eliminates this risk by making it very easy for you to always be aware of your balance and your transactions, both posted and otherwise.

For me, the biggest value in online banking is online bill pay. If I pay a bill online via my bank, I?m not using a stamp. That?s $0.45 saved on every bill I pay using online banking instead of paying via check. It?s also more secure, as I?m not passing my check (with my name, address, signature, routing number, and account number) through the postal service which relies on trust of postal employees (they are trustworthy, but it?s still a security risk).

Also, if you?re willing to bank online, many more banking options become available to you. Many banks, such as ING Direct, operate almost entirely online. To make up for the lack of a storefront, they often pay great interest rates and offer other features that make them quite tempting (like a very robust online bill pay). If you include these banks in your survey when you switch, you?re likely to end up with a bank with lower fees and higher interest than you would have found otherwise.

Online banking is one of the services that pays for my internet connection. Without it, I would most likely mail in my bills and I most likely would have savings and checking accounts with lower interest rates. I?d also be devoting more time to banking practices.

If you?re a technophobe, don?t be afraid to ask for help. Online banking is pretty easy to use, and if you avoid a few basic security pitfalls, you?ll be fine. My quick suggestions: never click on links in your email, use a password with lots of numbers and upper and lowercase letters, and always make sure you?re visiting the correct URL for your bank. Those three steps alone take care of the vast majority of paths to internet fraud.

If you can?t afford home internet access, don?t be afraid to use community resources for internet access. One local bank, for example, has a computer available there that people can use to access their online banking and bill pay features. If your bank offers that, use it. Every bill you pay online saves you $0.45, after all. Just take your bills there a couple times a month.

Online banking is nothing but a value for the customer, as long as you?re careful and use basic security precautions. It provides extra savings, better services, and more convenient access.

Canon imageFormula P-215 Scan-tini Personal Document Scanner


A close cousin to the Editors' Choice Canon imageFormula P-150 Scan-tini ($295 direct, 4 stars), and one small step up in Canon's line, the Canon imageFormula P-215 Scan-tini Personal Document Scanner ($325 direct) combines a not quite identical scanner with improved software. The result is an even more attractive package, both as a portable scanner and as a small-size personal desktop scanner. It's also the new Editors' Choice for its category.

The P-215 is so similar to the P-150 that it's hard to see a difference. At 1.6 by 11.2 by 3.7 inches (HWD) and 2.2 pounds, it's just a little bigger (by 0.2 inches in one dimension), a little heavier (by 0.1 pound), and costs just a little more. However it's otherwise nearly identical, with a 20-page automatic document feeder (ADF), duplexing (the ability to scan both sides of a page simultaneously), and even the same claimed speed.

Canon rates both scanners in both grayscale and black and white modes at 15 pages per minute (ppm) for both simplex (one-sided) and duplex (two-sided) scans, and at 30 images per minute (ipm) for duplex (with one image on each side of the page). Color mode is a still reasonable 10 ppm and 20 ipm. Beyond that, the scanners share most of their specifications point for point. However, Canon says that the P-215 adds the ability to scan hard plastic cards, like embossed ID cards and driver licenses.

Setup
One welcome improvement for the P-215 is easier setup for the scanner itself. With the P-150 you had to install a part in the scanner by following confusing instructions. The P-215 comes out of the box ready to work. Setup can be as simple as connecting the supplied USB cable. However, you also have other choices.

The P-215 gets power over the same USB cable it uses for data. It can also get additional power from an optional AC power supply (although it's not available at this writing) or from a second supplied cable that plugs into the scanner's power supply connector on one end and a second computer USB port on the other. Canon says that using the power supply or second cable will boost scan speed, but I didn't see any difference in my tests. Given that different USB ports can supply different levels of power, you may or may not see a difference on your computer.


Software choices
You also have the option whether or not to install software. If you don't want to install any, you can use the Canon CaptureOnTouch Lite utility stored in the scanner's memory. Connect by USB cable, and the computer will see the memory as a USB drive. Depending on how your computer is set up, it will then either launch the utility automatically or let you run it manually.

Alternatively, you can install the full version of CaptureOnTouch, which gives you much more control over the scan settings. You can also install a Twain driver, which will let you scan directly from most Windows programs; Nuance PaperPort 11 for document management and optical character recognition (OCR); NewSoft Presto! BizCard 6 SE for scanning and managing business cards; and connectors for Google Docs, Evernote, and Microsoft Sharepoint.

The software installation is mostly standard. However, it suffers from the same issue as the installation program for the Canon imageFormula DR-C125 ($495 direct, 4 stars) that I recently reviewed. During installation, you need to choose between a Typical or Custom install. With most scanners, the Typical option would install everything. With the P-215, however, it installs only the driver, scan utility, and user manual.

As I pointed out in the DR-C125 review, these choices really should be labeled Minimal and With Programs. At the very least, there should be some additional information explaining what each choice installs. Without it you may well go ahead with the Typical choice and never know that there are other programs available or how to install them.

Choosing Software
I tested the P-215 on a system running Windows Vista and with all four setup options?using one cable and two in combination both with CaptureOnTouch Lite and with the full set of installed software. Adding the second connection made no difference in speed with either software choice. However, the software makes a noticeable difference in usability.

CaptureOnTouch Lite will let you scan to searchable PDF files as well as image PDF, JPG, BMP, and other image file formats. The full version of the utility adds much more control over scan settings, while PaperPort and BizCard 6 add document management, the ability to recognize text and save it in editable format, and the ability to scan and manage business cards. What this adds up to is that unless you have a very good reason not to, you should install the software on your hard disk.

Performance
The P-215 offers a 600 pixel per inch (ppi) optical resolution, which is much more than you need for document scanning. Its default setting is 200 ppi, which is generally sufficient. In my tests, using the default settings of 200 ppi and automatic color detection, scanning to a PDF file, and giving the scan command from PaperPort, a 10 page document in both simplex and duplex modes matched the claimed 10 ppm and 20 ipm for color scans, but took an extra 35 seconds to save the file, so the effective speed was 6.3 ppm and 12.6 ipm. That's an acceptable speed even for a personal desktop scanner. For a portable scanner it's blazingly fast.

Much more important is that the P-215 doesn't slow down when you scan directly to a searchable PDF file. Only a few other scanners, mostly from Canon, can manage this trick. The DR-C125, for example, doesn't slow down at all for text recognition, and the P-150 adds just a few seconds. In contrast, the Fujitsu ScanSnap S1300 ($295, 3.5 stars), like most scanners, takes a significant amount of extra time for text recognition, at 1 minute 43 seconds to scan 10 pages and save to an image file, compared with 2:37 to scan and recognize the text.

In addition to its fast scan speed, the P-215 scored well on our other tests also. Scanning to Word format, the combination of the scanner and PaperPort read our Times New Roman test page at sizes as small as 5 points and our Arial test page at sizes as small as 6 points without a mistake. Few scanners we've tested have done anywhere near as well for OCR accuracy.

Results for business cards were mixed. The scanner had trouble feeding stacks of cards, so I needed to manually feed some of them one at a time. The speed was also slow enough?at about 25 seconds per card?that a fast typist could do the job in less time than it takes to scan and then check the results. However, the accuracy was good enough to be useful, with errors on fewer than half of the cards, and most of those having only one or two errors.

Despite the lackluster results on our business card tests, the Canon imageFormula P-215 Scan-tini Personal Document Scanner is more than a little impressive. It's fast, particularly for scanning to searchable PDF format; it offers an ADF and duplexing; and its text recognition is unusually accurate. The combination makes it a standout winner, both as a capable personal desktop scanner and even more so as a portable scanner that doesn't force you to make compromises. By any measure, it's an easy pick for Editors' Choice.

Google's first act with Motorola Mobility under its wing? Picking a new head for the company, apparently. According to some anonymous-type sources over at Bloomberg, Mountain View "is close" to picking its own SVP, former ad man Dennis Woodside, to succeed Sanjay Jha. Google, naturally is refusing to comment on the matter, which is still waiting the completion of the $12.5 billion acquisition.

Housing perks up, but prices are still falling

Though the pace of home sales picked up?last month as the economy and job market improved, home prices have yet to show any meaningful turnaround.

The National Association of Realtors said Wednesday that sales of existing homes ? which account for most of the housing market - ?rose 4.3 percent in January.?That pace of sales, about 4.5 million a year, is still much less than the 6 million rate that?s considered ?healthy.? And it?s far below the peak of 7 million homes sold in 2005.

Home prices are still going nowhere ? they fell 2.2 percent in January, according to the NAR. That?s because there is still no end in sight to home foreclosures: so-called ?distressed? home sales accounted for 35 percent of sales in January, up from 32 percent in December. As those homes are sold, they push prices lower for all houses on the market.

When foreclosures began rising in 2007, banks that were seizing homes moved them fairly quickly onto the market. But as the demand for housing shrank and prices dropped, bankers had more properties than they could sell without big price cuts. More recently, banks have been managing their foreclosure pipeline to avoid having too many houses on the market at once.

That process delayed foreclosures, as bankers wait to sell one home before scheduling the next foreclosure sale. As home sales improve, more of that ?shadow inventory? of houses in the pipeline will eventually come to market.

??We think the foreclosure process will accelerate, which will speed up the flow of distressed inventory,? said Michelle Meyer, an economist at BofA Merrill Lynch Global Research in a note to clients Wednesday

Home prices have pulled back fastest in parts of the country that saw the biggest run-up during the housing boom. But the latest figures show prices falling in every region of the country. In the Midwest, which was largely spared the worst of the housing collapse, prices fell by 5.5 percent on average in January. In the West, where prices have been hardest hit, the drop was a modest 0.7 percent. Prices fell 2.2 percent in the Northeast and 1.4 percent in the South, according to the NAR.

Once prices stabilize, they have a long way to go before recovering their 2005 peak; some estimates expect that to take until 2020. For historical reference, the last time home prices fell 33 percent was in?the 1930s? when the full cycle from peak to trough to peak took 19 years.

Record low interest rates have made houses more affordable, but it?s not likely they?ll fall much further. The Federal Reserve recently made an unusual public promise to keep rates low for the next three years. But as the economy continues to improve, the odds are that rates will move higher not lower from here.

Home buyers who take the plunge, meanwhile, are summoning up plenty of patience when it comes time to apply for a mortgage. Lenders are being extremely choosy about who they approve - even for borrowers with a steady job and good credit.

As the housing market has been suffering from an excess of supply of foreclosed homes, demand for houses has been falling?for a variety of reasons. Many of those foreclosed families face a long wait to rebuild their credit and household finances before diving back into homeownership. The drop in home prices has left roughly 12 million homeowners ?underwater,??owing more than their house is worth. Many of those are potential ?move-up? buyers who are now unable to sell their current home without taking a big loss.

There has also been a sizable drop in the number of new household formations, which have fallen to the lowest level in decades. Before?2007, new households in the U.S. were formed at the rate of about 1 million to 1.3 million a year. That pace has fallen to between 600,000 and 700,000, according to a recent analyst by Goldman Sachs economists.

There are a variety of reasons for the slowdown, according to the report. The biggest single factor is the larger share of 18 to 34-year-olds who are choosing to live with their parents. Falling marriage rates have also put a damper on new household formations, along with high unemployment rates that force people to ?double up? with friends or family.

Economists expect the household formation rate to?recover to historical norms, rising to 800,000 this year and level off at 1.1 million in 2013.

Payroll tax cut full of budget gimmicks

There are two gimmicks happening here. Both are functions of the 10-year budget window the Congressional Budget Office and the Joint Committee on Taxation use to score legislation.

The other day, I criticized the unwillingness of Congress to finance the latest extension of the payroll tax cut. Since that blog, the Congressional Budget Office released its estimates of the cost of the entire mini-stimulus, including the so-called ?doc fix? and changes in unemployment compensation. And the games were even worse than I feared.

Congress made no pretense of paying for the payroll tax cut itself. But it did claim it would pay for the rest of the package. Hint: It didn?t.

The first gimmick allows Congress to pretend tax cuts or new spending are temporary, when it is obvious to all they are not. ?The second is a sort of congressional lay-away plan. Lawmakers get to buy politically popular policies today but avoid paying for them until years from now.

There is nothing new in all this. Congress has been playing games with the 10-year budget window (or its cousin the 5-year window) for decades. But the mini-stimulus showed business as usual is alive and well on Capitol Hill, despite the best efforts of the tea party caucus. ?

The doc fix is a perfect example of Gimmick #1. Even though Congress has been temporarily protecting physicians?from scheduled Medicare cuts for a decade, CBO must score only what Congress proposes.

So when lawmakers protect docs?for only a year (or in this case 10 months) at a time, CBO has no choice but to score only the one-year cost. Thus, the limited fix appears to add only?about $18 billion to the deficit over the 10-year budget window when the true 10-year expense of keeping the doc fix going would far exceed $200 billion.

Perhaps the payroll tax cut, which is supposed to be a stimulus measure, really will be allowed to expire at year?s end (though I doubt it). But the doc fix is not countercyclical economic policy. Like old man river, it just keeps rolling along. A year at a time.? Since 2002, if you can believe it.?

Here?s Gimmick?#2. Most of the cost of the doc fix comes in fiscal years 2012 and 2013, as you?d expect with a ?temporary? extension. But the measures to pay for them?a reduction in Medicare payments for hospitals? bad debts and a cut in a preventive care program, don?t kick in until 2014 and beyond. One provision?a hike in federal employee retirement contributions for new workers?won?t start raising real money until 2016.

Will any of these pay-fors actually happen? Don?t bet on it. Already, Senate Democratic Leader Harry Reid (D-NV)?has promised to restore the preventive care money. That took, what, four days?

In theory, this kind of budgeting makes sense. After all, while the economy seems to be recovering, it remains sluggish. Why not inject additional fiscal stimulus now and arrange to pay for those initiatives in a couple of years when the economy presumably is stronger?

The problem: Many of these pay-fors never quite seem to happen. Instead, Congress just creates more ?doc fixes.?? ?Remember, the first fix was aimed at blocking cuts in Medicare physician payments that were?included in the Balanced Budget Act of 1997.

Yes, Virginia, Congress promised that cutting reimbursements to docs would help eliminate the deficit. And, as Sarah Palin, might ask, ?How?s that workin? out for ya??

Paul Babeu, Outed GOP Candidate, On Same-Sex Marriage: 'You Can't Legislate Love'

Republican congressional candidate Paul Babeu, who was outed as gay last week and accused of threatening his ex-boyfriend with deportation, said Monday that he supports same-sex marriage and the right of gays and lesbians to serve in the military.

"If it's not harming somebody else, than it doesn't matter," the Arizona sheriff said of same-sex marriage in an interview with CNN's Wolf Blitzer. "You can't legislate love."

Babeu also denied claims by his ex-boyfriend -- a man identified as only Jose by the Phoenix New-Times, which broke the news of the allegations -- that he and his attorney had threatened the man with deportation. Babeu acknowledged that he had had a relationship with Jose, and said it lasted for about three years.

"One, he's legal. He has said that. I've said that," Babeu said. "And then, in addition, this whole thing about deportation, we all know I don't have deportation authority. I have the authority to arrest. There were several crimes committed here against me and my campaign."

Jose volunteered for Babeu's congressional campaign, updating his website and handling social media. Babeu said that after the two had broken up, Jose committed crimes against him, including posting defamatory information online under Babeu's name. Babeu first mentioned the alleged crimes on Saturday, when he held a press conference to discuss Jose's allegations.

Babeu stepped down on Saturday from his position as Arizona co-chairman of Mitt Romney's presidential campaign. A spokeswoman for Romney, the former Massachusetts governor, said Babeu was cutting ties with the campaign in order to "focus on the allegations against him."

Babeu told CNN that Jose's claims were politically motivated, questioning why he had decided to come forward now.

"The timing of this should be clues to everyone that's listening," he said.

He also said it was not the first time he'd been attacked for being gay. During his time in the military, Babeu said, his fellow service members had reported his sexuality to higher-ups, something he said shouldn't happen as "we progress in society." When he commanded troops, he said, he knew that some of the men and women who served under him were gay, as were some of the most exemplary service members that he had met.

Same-sex marriage should be allowed in states that vote to approve it, he said, although it should not be mandated in cases where religions prohibit it.

Babeu said that being gay should not impact the way voters think of him, adding that he may work with the Log Cabin Republicans, an advocacy group for gay and lesbian Republicans, and that he wanted to focus on the issues.

"Our party is the big tent, as Ronald Reagan talked about, the party of Lincoln, of equality," he said. "This is not something I believe, in this day and age, should by itself defeat or elect any candidate, even in this Republican party."

"This is 2012. I should be judged on merit, on my performance and results," he added.

Because with these acquisitions, Oracle and SAP have effectively validated the cloud and sounded the death knell for ERP (enterprise resource planning). Why? Because SAP and Oracle are acquiescing to the cloud, yet they have no strategy to get their customers there. If SAP and Oracle were serious about the cloud, where are their big cloud solutions or visions for migrating customers?

The Wireless Future Looks a Little Darker Without LightSquared

Most gadgeteers gloss over Federal Communications Commission (FCC) approvals and wireless spectrum news. It?s dry stuff. But there was a big development this week, as the FCC announced that it will block the rise of LightSquared?s new 4G network, a decision that may impact data users (along with our wireless bills) for years to come.

Who Is LightSquared, and What Happened?


LightSquared had a plan. The firm, backed by billionaire Philip Falcone, was to license a piece of the wireless spectrum and use satellites and land antennas to build a 4G network of its very own. This network wouldn?t be owned by the big carriers like AT&T or Verizon. Rather, any company interested in entering the market could license a chunk of it from LightSquared, providing a possible route for smaller companies and startups to compete with the enormous carriers.

LightSquared originally licensed its piece of the spectrum in 2004. In 2011, the FCC gave its tentative approval for LightSquared to begin an eight-year terrestrial build-out, in which the company would team with Sprint in a 15-year deal to share technology and costs. People liked the idea. LightSquared raised roughly $3 billion in investments from Falcone?s Harbinger Capital Partners and other firms within the last two years. Even Best Buy was a signed customer.

Then the National Telecommunications and Information Administration (NTAI) tested the technology.

The NTAI is the member of the executive branch that sees over (and advises the president on) telecommunications policy and manages the federal government?s use of the wireless spectrum. And a big part of its job is working with the FCC to research the effects of proposed legislation on open spectrum.

The agency found that while LightSquared indeed worked as advertised and within the bounds of its license, the signal?which butted up against the radio bands used for GPS?was interfering with dozens of GPS devices such as those found in the navigation systems of some aircraft. Why? Some GPS receivers were actually built to read wireless signals a bit beyond their purview in the spectrum. When the GPS snagged some of LightSquared?s signal, readings went haywire.

So the FCC and LightSquared have reached an impasse. The FCC, starting a dangerous scenario for an indefinite number of GPS users (we still don?t know whether the commission is worried about thousands, hundreds of thousands, or millions of affected devices, though LightSquared claims 99.5 percent of GPS receivers are unaffected), pulled its go-ahead for LightSquared?s network, leaving the company and its network in the lurch. LightSquared has suggested hypocrisy on the FCC?s part, calling out the commission for designating a certain stretch of spectrum for GPS receivers yet allowing those receivers to read signals outside the spectrum, then quashing LightSquared?s plan because GPS devices cross over into its territory.

But GPS was here first. And Lightsquared can?t change the fact that there are GPS units in the field reading the wrong spectrum. It can?t push a firmware fix to third-party GPS devices, especially when firmware might not even be the problem. In a last-ditch effort, LightSquared is even talking to the Department of Defense about swapping wireless frequencies?a solution that sounds like a stretch to say the least.

Why This Is Bad News


LightSquared wasn?t just one more network to compete against the likes of Verizon and AT&T. Its network could have launched many cellphone/wireless Internet providers, all of whom could have licensed LightSquared?s technology on the back end and offered unique cellphones and pricing plans on the front end.

As information becomes more of a commodity and major carriers put tighter restrictions on download limits (as we?ve seen already in the past few years), marketplace competition is key to balance the equation?and LightSquared was poised to sell data wholesale. So for consumers, its potential demise means a marketplace where carriers have a lot more power because of less competition.

But someone could succeed where LightSquared failed, right?

Clearwire, in which Sprint is a majority shareholder, still exists as a wholesale alternative. But LightSquared?s LTE technology is more promising than Clearwire?s existing WiMAX network. Clearwire is updating its network to LTE but may have problems paying for it. And the fact that Sprint chose to invest in LightSquared, rather than doubling down to help its old flame succeed, doesn?t speak well for Clearwire?s future.

Any new company entering the market now would need years to plan and deploy a nationwide wireless network. Even if someone could negotiate more open spectrum, there?s real estate to license and towers to build. We?re simply losing time.

Also, while LightSquared was facing $14 billion in infrastructure investments, its business plan didn't seem like a gamble?not with every American who owns a cellphone as a potential 4G customer. Investment flowed. But who wants to back a pricey startup knowing the FCC could unapologetically pull the plug on any new chunk of open spectrum, even if you?ve played by its rules? The next wave of 4G investors and entrepreneurs may just take their ambitions elsewhere.

Ultimately, the FCC is trying to protect us. GPS makes up an increasingly large part of our transportation infrastructure; this issue is potentially one of public safety. But LightSquared became the whipping boy for sloppy technology that it had nothing to do with. The FCC locked down the airwaves but failed to lock down the technology using those airwaves?a shortsighted move that hurts consumers and, at least for now, appears to have rendered a prime section of the wireless spectrum unusable.

We need properly enforced regulation to ensure that this doesn?t happen again. Because as of today, there?s no reason to think that it won?t. And that sure stinks for tomorrow.
